RERA was introduced in 2016 and came up with an act Real Estate (Regulation & Development) Act 2016 which aimed to protect the interest of the home buyers and regularize investment and promotion in real estate industry in India and at the same time have a mechanism for speedy dispute redressal.

Under the Act, Regulatory authorities for RERA are established at the state level for regulation of the real estate sector and to manage all the registrations and approvals related to registration of the commercial and residential projects. Advantages of RERA Registration

Right to Information

Buyer has all right to get information about the land/building which he is planning to purchase. RERA Act helps buyers to know the accurate details of the property from construction to delivery of the project.

No delay in projects

Under RERA Act, builders have to give the due date of possession of the flat and if delayed in completion of project will have to face many penalties under the Act.

Builder responsible for any default

If a buyer discovers any default in the flat or the building within 5 years after the possession of the flat, they can make a complaint and such default shall be ratified within 30 days of the complaint at no extra cost.

Advertisement of Projects

The promoters of the project are not allowed to advertise the sale/purchase of the property unless they are registered under the Act. Registration under RERA will make way for the promotions.

Commercial or residential land of over 500sq m
Commercial or residential real estate having more than 8 apartments
Agents engaged in selling / purchasing of properties

Documents required to register an on-going project

Copy of PAN card, Aadhaar card and photograph of Promoter/Partners

Past Executed / Ongoing Project Experience In Last Five Years

Development plan

Project details such as the layout, location, price and sanctioned plan of the project

Audited financial statements and Income Tax Returns (ITR) of the last 3 years

Title Deed along with the chain of title

Details of the contractor, Structural Engineers, Architect and Plumbing Consultant

Ownership documents such as proforma of the Allotment Letter, Conveyance Deed and Sale Agreement

Details of construction technology type, designing standards, resistant measures in case of uncertain events etc.

Note:- In case of NRI or Foreign National documents of Directors and Subscribers must be notarized or apostillled.

Process of Registration Under the RERA

Complete the Application FormYou are requested to first fill the simple questionnaire provided by our expert team.

Exceptions of RERA Act

  • Where area of land proposed to be developed does not exceed 500 sq m or number of apartments proposed to be developed does not exceed eight, inclusive of all phases. While the central government provides for these minimum area requirements the local governments can change the area requirements to conform to the Act, if required such minimum area threshold can be revised even lower.
  • Where promoter has received completion certificate for Real Estate Project prior to commencement of Act
  • For purpose of renovation or repair or re-development which does not involve marketing, advertising, selling or new allotment of any apartment, plot or building, under real estate project
